JOB DUTIES • Adjust and/or negotiate settlement of cargo claims in accordance with policy terms and conditions and accepted adjusting principles. • Provide technical expertise in interpreting contractual obligations and applying that knowledge to resolve cargo claims. This would include knowledge of Carriage of Goods by Sea Act (COGSA) as well as 49 CFA 1005 (PRINCIPLES AND PRACTICES FOR THE INVESTIGATION AND VOLUNTARY DISPOSITION OF LOSS AND DAMAGE CLAIMS AND PROCESSING SALVAGE). • Interview witnesses, suspects, claimants and subject-matter experts. • Investigate legal issues and confer with legal counsel on claims requiring litigation. • Represent company at legal proceedings as required or directed by Claims Manager. • Negotiate agreements to resolve disputes. • Detect and evaluate adverse claim trends and may be required to assist in loss control/loss prevention projects. • File subrogation claims and determine solutions in compliance with existing regulations and within company procedure with the objective of protecting the corporation. • Perform legal risk management analysis to identify potential regulatory challenges and determine whether to proceed with mitigation or transfer methods. • Conduct detailed bill reviews to implement sound litigation management and expense control. • Report information to managers or other designated personnel. • Other duties as determined/directed by line management.
MAY TRAVEL TO VARIOUS LOCATIONS THROUGHOUT THE UNITED STATES, LATIN AMERICA AND THE CARIBBEAN 5-10% OF THE TIME.
EDUCATION Bachelor’s in Business, Risk Management, Law or related field or foreign equivalent.
